PERSONAL DATA NOTICE

The Personal Data Protection Act 2010 (hereinafter referred to as the “PDPA”), which regulates the processing of personal data in commercial transactions, applies to Greenyield Berhad and its related companies (hereinafter collectively referred to as “Greenyield”, “our”, “us” or “we”). For the purpose of this personal data notice, the terms “personal data” and “processing” shall have the meaning prescribed in the PDPA.

Notice

  1. This Notice applies to any person whose personal data is processed by Greenyield.
  2. This Notice serves to inform you how your personal data is being processed by Greenyield or on behalf of Greenyield.

Personal Data

  1. Personal data processed by us may include:-

a) your name, job title, company name;

b) age, gender, date of birth, national registration identity card number, passport number;

c) race, ethnic original, nationality;

d) contact details including emails, address, telephone number;

e) medical records of Greenyield staff;

f) the particular of immediate family for the Travel and Medical Insurances; and

g) any other personal data or information that we may required from you.

Purpose of Personal Data

  1. We may use your personal data for the following purposes (“Purposes”):-

a) response to your inquiries and/ or to communicate with you;

b) processing any sales transaction and/ or preparation of related documents;

c) to provide services to you and/ or to provide you with information of our products and services;

d) for use in sales promotional activities of the Company;

e) in bids or proposal submitted for Technical Consultancy Services to International clients;

f) to facilitate your compliance with any laws or regulations applicable to you;

g) to consider applications for employments;

h) to conduct our internal activities, credit assessment and background check, market surveys and trend analysis, as well as

i) any other purposes as may be related to the foregoing.

Disclosure of Personal Data

  1. Your personal data may be disclosed to:-

a) our parent company, subsidiaries, related or affiliated companies;

b) our directors, authorised employees or representatives, auditors, advisers, consultants, professional firms or entities;

c) our business partners, service providers, freight forwarders, shipping agencies/ firms/ entities, banks and/or financial institutions;

d) to all governmental deparment and/or agencies, regulatory and/or statutory bodies;

e) the public at large by publishing the same in accordance with the relevant rules of Bursa Malaysia Securities Berhad; or

f) to any other person which Greenyield may think fit or necessary.

Notwithstanding that any such persons may be outside Malaysia, for any of the Purposes or any other Purposes for which your personal data was to be disclosed at the time of its collection or any other Purpose directly related to any of the above Purposes or where such disclosure is required or authorised by law or by order of a court.

Access to and Changes in Your Personal Data

  1. You are responsible for ensuring that your personal data is kept up to date. You may access and request for correction of your personal data and/or limit the processing of your personal data, or make any enquiries or complaints in respect of your personal data, by contacting us at the address below:-

  1. Your personal data is collected from various sources, including information you have provided us, information from third parties and information from credit rating agencies such as CTOS, RAMCI or equivalent and public domain.

Security

  1. We shall keep and process your personal data in a secure manner. We endeavour, where practicable, to implement the appropriate security measures and procedures in accordance with the PDPA and relevant regulations.

Personal Data Sharing/Transfer

  1. Your personal data may be transferred to a place outside Malaysia.

Failure to Provide Personal Data

  1. Unless otherwise specified by us at the time the personal data is collected, it is obligatory that you supply the personal data requested by us.
  2. If you fail to supply to us the personal data as requested by us, we may not be able to process your personal data to carry out the Purpose(s) as set out above.

Languages

  1. This Notice shall be drafted in English as well as in Bahasa Malaysia. In the event of inconsistency between the English version and Bahasa Malaysia version, the English version of this Notice shall prevail.

Changes to Personal Data Notice

  1. We reserve the right to amend this Notice from time to time without prior notice. We advised that you check this Notice on a regular basis.
